Suspended License
Many Pennsylvania drivers do not know that they have certain rights if their licenses are suspended. They are not aware that in Pennsylvania they have the right to apply for a "work" license, and under some conditions, may be eligible to drive even though they are suspended. There also exists the right to appeal convictions that resulted in suspensions, even if the convictions occurred many years ago. Drivers also have the right to have their records reviewed and corrected by the Department of Transportation and to demand credit hearings for suspensions when circumstances permit. Some out-of-state drivers are discovering that their home state licenses are being suspended because of suspensions or citations in Pennsylvania. These drivers have rights too. Some senior citizens are being notified that their operating privileges are being recalled because of some medical condition. They too have the right to appeal these decisions and keep their licenses.Several recent clients I have represented have encountered some of the above problems. For example, a former Pennsylvania resident now living in Virginia could not secure a Virginia license because his Pennsylvania driving privileges were suspended as a result of convictions for traffic violations from years earlier. I was able to have this client's convictions overturned. His Pennsylvania privileges were restored and he was able to secure a Virginia license, all done without him having to leave Virginia and coming to Pennsylvania.
Another frequent problem Pennsylvania driver clients have is being required by life necessities to continue driving, even if their licenses are suspended. They have to drive for work and to support their families and have no other choice but to continue driving. Through the process of Court petitions, hearings and appeals I am able to have suspensions removed or reduced, thus enabling these clients to secure a work license or a full license so they can drive legally again. You need to contact me if you find yourself in this situation.
DUI
We provide complete representation for this criminal charge, which will result in fines, possible imprisonment and a one year suspension of your operating privileges in Pennsylvania. If you are an out-of-state driver convicted in Pennsylvania you will lose your operating privileges in your home state too. Under certain conditions some of these penalties can be avoided. You also need to be aware of your rights if an officer stops your vehicle. Did he have authority to do so? If not, there is a possibility that all of the evidence of intoxication can be excluded from your trial.TRAFFIC CITATIONS
Certain traffic violations result in automatic license suspensions. Others result in assessment of points to the driving record. If a Pennsylvania driver accumulates enough points his/her license will be suspended. Before you pay a traffic fine you should call me to determine if a suspension will result. Do not depend upon the advice of a Court officer or a police officer as to the accuracy of their information about the consequences of paying a fine for a traffic citation. Many clients have followed that type of advice and then found out, to their detriment, that the advice was incorrect. In addition, certain violations and convictions can effect your insurance coverage and premiums. You need to know the answers to these questions before you pay fines and plead guilty. You need to know that paying a fine is a guilty plea, even if you did not intend to do so.Oversize/Overweight Problems
If your oversize/overweight haul has been cited by any Pennsylvania law enforcement agency for violation of a heavy haul permit, your load has been taken back to the legal limit and fines calculated from that weight, I can defend against these charges. I have represented many trucking companies and drivers against these types of charges with success. I am former counsel for a major heavy-haul trucking company and am familiar with all aspect for these types of violations.Permits Voided
A frequent event for heavy-haul movements in Pennsylvania is the voiding of permits for violations of the conditions of a permit or for traveling off the permit routes specified. The result is a major fine to the driver and/or trucking company. There are certain available defenses to these charges. If this happens to you, you need to call me for information and representation.
